Acceptance of terms

These Terms of Service (“Terms”) govern your access to and use of Build Tack, a construction management platform operated by Kshetrapal Infra Project Pvt (“Build Tack”, “we”, “us”, “our”), including our website and the CRM application at client.buildtack.com and related subdomains (together, the “Service”).

By registering for, accessing, or using the Service, you agree to be bound by these Terms on behalf of yourself and, if you are registering for a company, on behalf of that company (“you”, “your company”). If you do not agree, do not use the Service.

The service

Build Tack provides a multi-tenant SaaS platform for managing construction projects, teams, attendance, tasks, materials, purchase orders, finances and related documents. Each registered company (“tenant”) gets an isolated workspace identified by a unique client code.

Accounts & access

• You must provide accurate information when registering and keep your login credentials confidential.
• Your company's administrator is responsible for managing which users have access to your workspace, and at what permission level.
• You are responsible for all activity that occurs under your account. Notify us immediately at buildtacksupport@gmail.com if you suspect unauthorised access.
• We may offer optional phone-based two-factor verification; if enabled, you are responsible for keeping the associated phone number current and accessible.

Your data

All project, employee, attendance, financial and other business data you or your users enter into the Service (“Your Data”) remains your company's property. We do not claim ownership over Your Data, and we do not share it with other tenant companies.

You are responsible for the accuracy and legality of Your Data, and for having the necessary rights and consents to upload it (for example, employee personal data you enter for attendance or payroll-adjacent features). See our Privacy Policy for how we handle personal data generally.

On termination of your subscription, we retain Your Data for a reasonable period to allow export or reactivation, after which it may be deleted in accordance with our data retention practices.

Subscriptions, trials & billing

• Access to the Service is provided on a per-project subscription basis unless otherwise agreed in writing.
• Where a free trial is offered, its duration and scope (e.g. number of projects) will be shown at the time it is granted. We may modify or discontinue trial offers at any time.
• Fees, once due, are non-refundable except where required by law or expressly stated otherwise.
• We may suspend access for accounts with overdue payments after reasonable notice.

Acceptable use

You agree not to:

• Use the Service for any unlawful purpose, or in a way that infringes the rights of others.
• Attempt to gain unauthorised access to another tenant's workspace or data, or to probe, scan or test the vulnerability of the Service without our prior written permission.
• Interfere with or disrupt the integrity or performance of the Service (including via excessive automated requests).
• Upload malicious code or use the Service to store or transmit content that is unlawful, defamatory, or infringes intellectual property rights.
• Reverse-engineer, resell, or white-label the Service without our written agreement.

We may suspend or terminate access for any account that violates this section.

Availability & support

We aim to keep the Service available and performant, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance and unforeseen issues may cause temporary downtime. Support is available at buildtacksupport@gmail.com.

Intellectual property

The Service, including its software, design, branding and underlying technology, is owned by Kshetrapal Infra Project Pvt and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or brand assets, and they do not transfer ownership of the Service to you — only a right to use it as permitted here.

Disclaimers & limitation of liability

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the fullest extent permitted by law, Kshetrapal Infra Project Pvt shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or business opportunity, arising out of or related to your use of the Service. Our total aggregate liability for any claim relating to the Service shall not exceed the fees paid by your company for the Service in the twelve (12) months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

Suspension & termination

You may stop using the Service and close your account at any time by contacting us. We may suspend or terminate access to the Service, in whole or in part, if you breach these Terms, fail to pay applicable fees, or if required to comply with law. Where reasonably possible, we will provide notice before suspension or termination.

Governing law

These Terms are governed by the laws of India. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

Changes to these terms

We may update these Terms from time to time. Material changes will be reflected by an updated “Last updated” date at the top of this page. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
